Hold Israel Accountable for Genocide of Palestinians

Israel Is Deliberately Using โStarvationโ as Their Weapon
Children howling with hunger, dying of malnutrition; people approaching aid vehicles under gunfire; people surviving on animal feed and soup made from leaves and grass.
A severe famine has invaded the northern Gaza strip. 1.1 million people in Gazaโhalf of the populationโare faced with catastrophic hunger and starvation as they have completely exhausted their food supplies and coping capacities. One in three children under the age of two is acutely malnourished or undernourished; 28 children have already died of malnutrition.
Vehicles carrying aid supplies vital for survival are unable to reach the people of Gaza. This is because Israelโs authorization is required in sending aid to northern Gaza, but Israel is deliberately using โstarvationโ as a weapon to control the entry of aid. Hundreds of unauthorized aid vehicles are currently stopped at the border line. Israeli forces have repeatedly opened fire on Palestinians who approached the aid vehicles that barely managed to enter Gaza, calling them โthreatening.โ Israelโs attacks on aid workers have also been unrelenting. About 500 residents of Gaza have been killed while trying to receive aid, and more than 200 aid workers have been killed. It has also been a common occurrence for people to drown after jumping into the sea to collect air-dropped aid.


Israel Must Take โAll Measures within Its Powerโ to Prevent Genocide
Israelโs indiscriminate attack on the Gaza Strip is now in its sixth month. Gazaโs death toll has surpassed 33,899, with 76,664 injured (as of April 17). There is no safe place in Gaza; Israel is indiscriminately bombing schools, hospitals, churches, mosques, UN facilities, or universities, and more. Israel claims that more than two-thirds of the victims are Hamas members, but more than two-thirds of the victims are children and women.
Israel, which has illegally occupied Palestinian land, is violating international law and committing war crimes in blatant disregard of international society’s strong calls for a ceasefire. On January 26th, 2024, the International Court of Justice (ICJ) found that it is plausible that Israel is committing acts of genocide in Gaza, and ordered Israel to take all measures to prevent it. However, in the 50 days following the ICJโs order, Israeli forces have killed about 7,100 residents of Gaza. On March 25th, 2024, the UN Security Council adopted a resolution demanding an immediate ceasefire in Gaza, but even after the resolution passed, Israel mobilized warplanes to continue its bombardment of Rafah, the southernmost city in Gaza. Israelโs Prime Minister Benjamin Netanyahu has remained unwavering in his determination to impose a ground invasion of Rafah, where 1.4 million out of Gaza’s approximate total population of 2.3 million have sought shelter. This is completely unacceptable.
Francesca Albanese, UN Special Rapporteur on the situation of human rights in the Palestinian Territory occupied since 1967, noted that “The overwhelming nature and scale of Israelโs assault on Gaza and the destructive conditions of life it has inflicted reveal an intent to physically destroy Palestinians as a group.โ Albanese also highlighted that there are reasonable grounds to believe that Israel has committed the following three of the five acts of crime under the Genocide Convention: killing members of the group; causing serious bodily or mental harm to groupsโ members; and, deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part. Mexico and Chile have called on the International Criminal Court (ICC) to investigate Israel’s alleged war crimes.

In 2007, South Korea enacted the ใAct On Punishment Of Crimes Under the Jurisdiction Of The International Criminal Courtใ. Under this law, not only the International Criminal Court, but also South Korean law enforcement can investigate and punish those responsible for genocide, crimes against humanity, and war crimes.

Act On Punishment Of Crimes Under Jurisdiction Of The International Criminal Court
- Article 8 (Crime of Genocide) (1) Any person who kills a member of a national, racial, ethnical or religious group with intent to fully or partially destroy the group shall be punished by the death penalty or imprisonment for life or for not less than seven years.
- Article 9 (Crimes against Humanity) (1) Any person who has killed another person by making an extensive or systematic attack directed against any civilian population in connection with the policies of the State, organizations or institutions to commit such attack shall be punished by the death penalty or imprisonment for life or for not less than seven years.
- Article 10 (War Crimes against Persons) (1) Any person who kills a person protected pursuant to international laws on humanity in relation to international or non-international armed conflict (excluding situations of internal disturbances and tensions, such as riots, isolated and sporadic acts of violence or other acts of a similar nature; hereinafter the same shall apply) shall be punished by the death penalty or imprisonment for life or for not less than seven years.
- Article 12 (War Crimes against Humanitarian Activities, Distinctive Emblems, etc.) (1) Any person who commits any of the following acts in relation to international or non-international armed conflict shall be punished by imprisonment for a fixed term of not less than three years.
- Article 13 (War Crimes Using Forbidden Means) (1) Any person who commits any of the following acts in relation to international or non-international armed conflict shall be punished by imprisonment for life or for not less than three years.
- Article 14 (War Crimes Using Forbidden Weapons) (1)Any person who employs any of the following weapons in relation to international or non-international armed conflict shall be punished by imprisonment for life or for not less than five years.
This criminal accusation is based on Article 3(5) of the Act On Punishment Of Crimes Under Jurisdiction Of The International Criminal Court, which states that โThis Act shall apply to any foreigner who commits the crime of genocide, etc. outside the territory of the Republic of Korea and resides in the territory of the Republic of Korea.โ However, since those being accused in this case are not currently in the Republic of Korea, it is highly likely that the investigation will be closed without opening on the grounds of lack of jurisdiction.
Nevertheless, we are preparing to file charges to South Korean law enforcement against Israeli Prime Minister Benjamin Netanyahu and others responsible for the genocide of Palestinians for the following reasons:
- War crimes, such as the murder of civilians, are also covered by the ใGeneva Convention (IV) Relative to the Protection of Civilian Persons in Time of War (12 August 1949)ใ. Article 146 of the Geneva Conventions stipulates that โEach High Contracting Party shall be under the obligation to search for persons alleged to have committed, or to have ordered to be committed, such grave breaches, and shall bring such persons, regardless of their nationality, before its own courts.โ As a signatory to the above conventions, the Republic of Korea is obligated to investigate and prosecute those who commit war crimes, regardless of their nationality or presence in the country. Even if our accusation is dismissed, we will refile for a criminal case and strongly demand that an investigation be opened if the suspects enter South Korea.
- This indictment is a clear message of protest to Israel to stop committing war crimes. In particular, the filing of the criminal charge by specifically naming those responsible for genocide and war crimes and promoting this actionโs widespread publicity will send a strong message that war criminals must be remembered and punished.
