  • Paris Principles A.3(a)-(iv)

  • Paris Principles A.3(d)·(e) 및 SCA General Observation 1.4 (Interaction with the international human rights system)

Stakeholder Information Submission to the Global Alliance of National Human Rights Institutions (GANHRI) for The Re-accreditation of National Human Rights Commission of Korea (NHRCK)

1. Serious Human Rights Issues Facing the Republic of Korea and Problems at the National Human Rights Commission of Korea (NHRCK)

1) Hatred and discrimination against LGBTI persons

  • The Republic of Korea has still not enacted a comprehensive anti-discrimination law. As a result, LGBTI persons and people from particular regions are systematically exposed to discrimination and hatred by forces that promote them, yet there is no law or system to prohibit or prevent from discrimination. UN human rights treaty bodies, the UPR, and other mechanisms have repeatedly urged the Korean government to enact a comprehensive anti-discrimination law.
  • Statements and policies that promote hate speech and discrimination against LGBTI persons are spreading even in the public sphere including government ministries, the National Assembly, local governments, local councils, and public institutions, however the NHRCK has failed to respond adequately. In the past, as an independent human rights institution, the NHRCK continued to raise awareness of the need for a comprehensive anti-discrimination law and to urge its enactment, including by proposing an “Equality Act (draft).”
  • However, since Ahn Chang-ho became Chairperson of the NHRCK in September 2024, the Commission has cited “neutral review” and “freedom of expression” to condone hate speech and to give a platform to those who promote hatred and discrimination. It has also downplayed efforts to enact a comprehensive anti-discrimination law.
  • Relevance to the Paris Principles and SCA General Observation 1.6: In the absence of a comprehensive anti-discrimination law, the NHRCK’s retreat from its previous role of promoting such a law and actively combating  discrimination and hatred is inconsistent with the Paris Principles and the intent of GO 1.6 that require a national human rights institution to exercise its broad mandate to protect and promote human rights effectively and to actively recommend necessary legal and policy improvements.

2) The NHRCK’s abdication of responsibility amid the crisis of constitutional order and the rule of law

  • The declaration of martial law by the previous government on December 3, 2024 suppressed the fundamental rights and freedoms of all citizens in the Republic of Korea and all those residing in the country, and undermined Korea’s democracy and constitutional order.
  • In national crises such as the declaration of martial law, the NHRCK must monitor whether power is being exercised in an anti-human-rights or unlawful manner and must give top priority to protecting citizens’ rights. Nevertheless, Chairperson Ahn Chang-ho failed in this basic responsibility. He made decisions and recommendations that shielded those who led the martial law and even supported the legitimacy of the declaration.
  • On December 9, six days after the declaration, some commissioners proposed an “ex officio investigation and statement of opinion on the martial law” at a plenary meeting of the NHRCK. Other commissioners opposed it, saying “the President’s acts of governance must be respected.” Chairperson Ahn remained silent and moved the meeting into closed session. Only on December 11 did the Commission issue a perfunctory statement saying merely that the people’s human rights come first.
  • At the plenary meeting on February 10, 2025, the Commission adopted the “Recommendation on Measures to Prevent Human Rights Violations Related to the National Crisis Caused by the Declaration of Martial Law” (the so-called “Yoon Suk-yeol right of defense” agenda item). Six of the eleven commissioners, including Chairperson Ahn, voted in favor. The decision claimed there were no human rights violations caused by the martial law declaration, stating that “there were no cases of serious injury or death, and the extent of property damage appears to be minor.” It adopted the reasoning of the President who carried out the martial law and justified it as a “political and military act” against the then-opposition party’s abuse of impeachment, given its majority in the National Assembly. It also fostered distrust of the judiciary by singling out judges’ political leanings, and the decision was filled with speculative expressions such as “it is suspected” and “there is controversy,” undermining its professionalism and credibility.
  • Concerns regarding Paris Principles A.3(a)(iv):  A national institution must draw the government’s attention to situations of human rights violations in any part of the country, recommend measures necessary to end them, and, where necessary, express opinions on the government’s positions and actions. However, the NHRCK remained silent in a situation where democracy was undermined and citizens’ fundamental rights were at serious risk of violation, and it downplayed the gravity of that situation.

3) Chairperson Ahn Chang-ho personally ordered the deletion of content on LGBTI persons and other socially vulnerable groups from the NHRCK’s human rights report

At its 23rd plenary meeting on December 9, 2024, the Commission took up the agenda item “Publication of the 2023 Human Rights Report.” However, key content in the draft was extensively deleted or replaced, including case law related to LGBTI persons, the reduction of human rights education, and the fact that the WHO removed transgender identity from its list of illnesses. It was revealed that Chairperson Ahn Chang-ho personally ordered these deletions.

4) Abolition of the NHRCK’s anti-discrimination law course

“Understanding the Anti-Discrimination Act,” the flagship course that accounted for more than one-third of enrollments in the NHRCK’s Sex Discrimination Prevention Program, was abolished in 2024. It has been confirmed that Chairperson Ahn Chang-ho’s views were reflected in this decision. At the 8th Standing Committee meeting on April 10, 2025, Standing Commissioner Nam Gyu-seon demanded that the course be restored. Chairperson Ahn replied, “If we include a course on understanding the Anti-Discrimination Act, we must also include a course opposing the Anti-Discrimination Act.”

5) Failure to submit the NHRCK’s opinion on the follow-up to the UN Committee on the Elimination of Discrimination against Women (CEDAW)

On August 20, 2026, the NHRCK Standing Committee deliberated on an opinion submission concerning the government’s follow-up to the 9th Concluding Observations of the UN Committee on the Elimination of Discrimination against Women (CEDAW). At that meeting, various opinions were presented, including on intersectional discrimination affecting sexual orientation, gender identity, women with disabilities, and migrant women, and it was decided that the submission would be revised in light of them and then submitted.

However, Chairperson Ahn Chang-ho did not formally place the revised report on the agenda of the Standing Committee meeting on September 3. He even gave the head of the responsible division an improper separate instruction to submit to the UN a version from which certain content had been deleted, including content deferring enactment of an anti-discrimination law and content stating that intersectional discrimination, including on grounds of sexual orientation and gender identity, should be covered and remedies established.

The division head refused this improper instruction, stating that he could not follow the Chairperson’s instruction because it had not gone through a Standing Committee resolution. As a result, the NHRCK failed to submit its follow-up opinion to the CEDAW Committee by the deadline of September 4.

Concerns regarding Paris Principles A.3(d) and (e) and SCA General Observation 1.4 (Interaction with the international human rights system): A national human rights institution has a duty, from an independent standing, to provide information to UN human rights treaty bodies, cooperate with international human rights mechanisms, and promote and monitor the domestic implementation of their recommendations. The Chairperson obstructed the submission of an opinion that was being formed through a collegial decision-making process and instructed the submission of a separate opinion with specific content deleted. As a result, no opinion was submitted to CEDAW. This raises serious concerns about whether the NHRCK is effectively performing its role of participating independently in UN human rights mechanisms and promoting the domestic implementation of international human rights standards.

2. Problems Revealed Since Ahn Chang-ho Became NHRCK Chairperson

The NHRCK’s previous role on the above human rights issues

  • Independent investigation of major human rights issues; recommendations and opinions to the government and the National Assembly
  • Investigation of discrimination against social minorities, including LGBTI persons, women, persons with disabilities, and migrants and refugees, and recommendations for improving laws, systems, and policies
  • Open and sustained calls on the government and the National Assembly to enact a comprehensive anti-discrimination law
  • Efforts to ensure that international human rights standards are reflected in domestic laws and policies
  • Respect for UN human rights mechanisms as a national human rights institution independent of the government
  • Cooperation with civil society and provision of independent information on the domestic human rights situation to the international community

The NHRCK’s abandonment of its duty to protect and promote human rights since Ahn Chang-ho became Chairperson

Since Ahn Chang-ho became Chairperson in September 2024, the NHRCK has failed to respond effectively to the serious human rights problems facing Korean society.

  • Failure to respond to hatred and discrimination against LGBTI persons
    • Inadequate response to issues such as discrimination and hatred against LGBTI persons
    • Delay and restriction of case deliberation and handling due to the Chairperson’s intervention
    • Weakened capacity of the national human rights institution to protect victims, and diminished trust
    • Evasion of responsibility and dereliction of duty under the banner of “neutrality” toward discrimination and hatred
  • Failure to respond independently to the constitutional crisis, including the declaration of martial law
    • By turning away from its responsibility to restore citizens’ rights and the constitutional order violated by the martial law, and by adopting a recommendation centered on the former President’s right of defense, the Commission lost its role and function as an independent watchdog over state power
    • Failure to investigate and make recommendations on the human rights impact of the martial law, the protection of victims, and related matters
  • Loss of trust from civil society and victims
    • As the NHRCK’s evasion of responsibility, incompetence, and deliberate obstruction and delay on major human rights issues came to light, it lost the trust and expectations of civil society and victims. Trust that the NHRCK is an independent remedial body on which socially vulnerable people and victims of human rights violations can rely has been seriously damaged.

3. Concerns Based on the Paris Principles

In May 2026, the NHRCK submitted to the Global Alliance of National Human Rights Institutions (GANHRI) a confirmation of the Korean NHRCK’s compliance with the Paris Principles.

The NHRCK has made political decisions on some matters, dealt with major human rights issues selectively, and delayed its responses to them. As a result, it has not sufficiently fulfilled its responsibility to protect victims and minorities ahead of state power. This violates the core requirements of the Paris Principles: independence, effectiveness, a broad mandate to protect human rights, and cooperation with civil society.
